Hoopium Terms of Use

These Terms of Use ("Terms") govern your use of the Hoopium iOS app (the "App"), a basketball training app developed by Ethan Brown ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App is free and provided "as is"
The App is provided free of charge, "as is" and "as available", without warranties of any kind, whether express or implied — including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or available at all times.
2. Measurements and shot detection are estimates
Hoopium's vertical-jump measurement, automatic shot detection, and other tracking features are estimates generated by your device's camera and sensors. They may be inaccurate and should not be relied upon for any purpose requiring precision. Results can vary with lighting, camera placement, device, and technique. Do not use them for medical, competitive eligibility, or safety-critical decisions.
3. Train within your ability — safety disclaimer
Hoopium provides drills, timers, and exercise routines for general fitness and skill training. Physical exercise carries inherent risks. You are responsible for training within your own ability and for your own safety. Consult a qualified physician before beginning any new exercise program, warm up appropriately, use suitable space and footwear, and stop if you feel pain or dizziness. To the fullest extent permitted by law, we are not liable for any injury, loss, or damage arising from your use of the App or participation in any activity it suggests.
4. Third-party advertising
The App displays advertisements served by Google AdMob. Ads, and any websites or products they link to, are controlled by third parties, not by us. We are not responsible for the content of third-party ads or for any transaction you enter into with an advertiser. See our Privacy Policy for how advertising data is handled.
5. Acceptable use
You agree not to reverse-engineer, decompile, tamper with, or attempt to extract source code from the App except as permitted by law, and not to use the App for any unlawful purpose.
6. Limitation of liability
To the fullest extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the App, even if advised of the possibility of such damages. Because the App is free, our total aggregate liability to you for any claim relating to the App will not exceed NZD $0.
7. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above will reflect the most recent change. Continued use of the App after a change means you accept the updated Terms.
8. Governing law
These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles.
